Terms of service
These terms cover services operated by Gosuke Kawano, trading as POTENCIA CASTING. Paid photography, production and international PR have different contractual and pricing arrangements from free direct member matching.
Production, international PR and private applications
Corporate PR inquiries, private talent applications and overseas partnership proposals are reviewed by the operator. An inquiry or application alone creates no contract, charge or representation, and does not guarantee projects, bookings or income. The Japan-based and age-18 eligibility requirements below apply to free member matching. International work and participation by minors require an individual review of the arrangements and necessary permissions.
Paid project terms
Initial consultations and applications are free. Before operator-led work begins, we agree in writing the contracting parties, scope, talent or posting services, production, deliverables, fees, taxes, expenses, payment dates, changes and cancellation. Creator posts and advertising usage are considered separately, with media, duration, territories, paid advertising, reuse and exclusivity specified. Visits, sales and views are not guaranteed. Partner projects also require an individual agreement; an inquiry creates no subsidiary, branch, agency authority or exclusivity. The operator is responsible for their agreed role when acting as a contracting party.
Scope of the free matching provisions
Sections 1–11 below govern public profiles, project listings and member messaging in the free matching service. Paid operator-led work is subject to the provisions above and separately presented and agreed project terms.
1. Eligibility
You must be 18 or older, based in Japan, and use the service for independent business projects in Japan. Supply accurate information and obtain required agency or other permissions. Protect your sign-in credentials and notify us of misuse. Membership creates no employment, exclusivity or guarantee of work or income.
2. Platform role
We provide listings, discovery and member messaging. We are not a contracting party, agent, guarantor or custodian of payment in member-to-member projects. Members choose counterparts, negotiate, contract, deliver, inspect and pay, and check their own tax and regulatory duties. If the operator commissions or performs work, a separate agreement identifies that role and its responsibilities.
3. Fees and payment
Registration, listing, messaging and matching are free; no success fee applies. Members agree and pay photography, modelling or production fees directly. No escrow, payment guarantee or advance payment service is provided. Future paid plans require separate terms and opt-in. Operator-led production fee arrangements do not apply to direct member projects.
4. Project agreements
Registration, inquiries and applications alone do not form a project contract. The parties must intend to contract and agree the terms. Before work, record names and contacts, order date, scope, dates and location, deliverables, delivery and inspection, fee, taxes, expenses, payment date, rights, changes and cancellation in durable writing. Follow applicable freelance transaction and other laws. A template alone does not establish contract formation or legal compliance.
5. Publication rights
Profiles are public only when you consent and enable publication. Posting a brief makes it public. Public information may be indexed or saved by others and may persist externally after withdrawal. Ensure you have the necessary rights to post. The operator's permission is limited to storage, display and operation of the service, not independent advertising reuse or AI training.
6. Copyright and likeness
Copyright and the subject's likeness permission must be addressed separately. Payment alone does not transfer all rights. Agree media, duration, territory, paid ads, editing, onward use, portfolio use and exclusivity. AI training, synthesis and face or voice alteration require separate, explicit, purpose-specific consent.
7. Prohibited activity
No impersonation, misleading content, rights infringement, illegal or dangerous shoots, harassment, sexual exploitation, adult sexual-content recruitment, unconsented exposure or touching, discriminatory or threatening conduct, antisocial activity, spam, unauthorized personal-data collection, hacking, credential sharing or block evasion. Do not post unnecessary identity or bank documents. Employment placement, worker dispatch and labor supply requests are outside the service; actual working arrangements determine legal obligations.
8. Reports and safety
Members may report profiles, listings or conversations and block a member. We may hide content, restrict functions or suspend accounts for suspected violations or safety/legal needs, and explain reasons where practicable. Requests for review go to the contact address. Reports are reviewed as needed; round-the-clock monitoring, immediate responses, debt recovery or dispute resolution are not guaranteed. Contact police or emergency services for immediate danger.
9. Withdrawal and continuity
You can hide your profile in your account; your projects then stop appearing publicly. Request account/data deletion from your sign-in email. We delete or anonymize after proportionate identity checks, except records needed by law, unresolved disputes or misuse prevention. Keep your own contract and conversation records. Maintenance, outages or legal needs may interrupt service; advance notice is given where possible.
10. Responsibility
The parties resolve disputes about their own performance, payment, outcomes, safety and rights. We do not guarantee other members' statements or performance of contracts to which we are not a party. This does not exclude the operator's own contractual, tort, data protection or other legal responsibility, intentional misconduct or gross negligence, or rights under mandatory consumer law. The operator remains responsible as a party to their own photography/production contracts.
11. Changes and governing law
Japanese law applies, subject to mandatory law, and jurisdiction follows applicable law. Changes and effective dates are announced in advance as appropriate, with consent where required by law.
